End User License Agreement

This license agreement is a legal agreement between the end user (as an individual), hereinafter referred to as the User, and the software publisher, hereinafter referred to as SmoothCommit Sàrl. The software and any of its supporting documentation are hereinafter referred to as the Product.

By installing or using the Product, the User indicates their complete and unconditional acceptance of this License Agreement, hereinafter referred to as the Agreement.

Should there be any conflict between the terms and conditions of this Agreement and the terms and conditions of any other agreement between the User and SmoothCommit Sàrl in relation to the Product, the terms and conditions of this Agreement shall apply.

Purchase, Billing, and Right of Withdrawal

Payment: Orders are processed by our partner Paddle.com. Paddle is the Merchant of Record for all our transactions. By making a purchase, the User also accepts Paddle’s terms and conditions.

Right of withdrawal (EU/UK): In accordance with European legislation, the User has a period of 14 days to exercise their right of withdrawal. However, the User acknowledges that by downloading or activating the Product, they request the immediate execution of the service and thereby waive their 14-day right of withdrawal without cause.

Free Products

SmoothCommit Sàrl provides the following Products free of charge for home users: CopyTrans Viewer.

Evaluation License Agreement

As part of its service, SmoothCommit Sàrl agrees to provide trial versions of its paid Products, namely CopyTrans Studio. SmoothCommit Sàrl agrees to provide this service free of charge to allow users to verify compatibility prior to purchase.

Technical Assistance

SmoothCommit Sàrl provides Users that purchased a license with technical support by email within 24 hours. If in spite of the support team’s assistance, the Product fails to fulfill its purpose, we will refund you within 30 days of purchase, in compliance with the company’s Refund Policy.

Limitations of Liability

Having paid for the Product does not include any consideration for assumption of risk by SmoothCommit Sàrl, and SmoothCommit Sàrl disclaims any and all liability for incidental or consequential damages arising out of the use or operation of or inability to use the Product, even if advised of the possibility of such damages. Furthermore, the User indemnifies and agrees to hold SmoothCommit Sàrl harmless from such claims.

Copyright Notices

The Product is the property of SmoothCommit Sàrl. All rights for the Product belong to SmoothCommit Sàrl. These rights are not transferred as part of this Agreement. CopyTrans® is a registered trademark. All other trademarks referenced herein or in the Product are the property of their respective owners.

Limitations of Use

The User may not transfer, rent, copy or use the Product in any way, in whole or in part, except for personal use. The User may not modify, reverse engineer, decompile or disassemble the software or modify or reproduce the program documentation.

Privacy Policy

This privacy policy explains how SmoothCommit Sàrl (data controller) uses any personal information collected when users interact with the CopyTrans Studio website and software, in compliance with the GDPR.

What information do we collect about you when you browse the website?

We collect information about the way you browse our website through Google Analytics. The collected information includes your device, location, language, browser, and visited pages. When you make a purchase, our reseller Paddle collects your billing information (we never have access to your credit card data). We only collect basic information required to generate your activation codes: name, address, and email.

What information do we collect about you when you use the software?

By default, the software will send anonymized error logs to our servers when a technical problem occurs. You can disable this feature in the application settings. If you activate the software, we collect basic information about your PC: PC name, IP address, date, and time. While using the trial version, you may be asked to submit your email address to be given extra trial time.

Why do we collect this information?

We collect information about you to provide customer support, set up your account, and resolve technical issues. We make sure that we do not collect any personal data from you that we do not strictly need.

How long do we store your information?

Under French tax and commercial laws, we are required to keep your billing and basic personal information (name and address) for a minimum of 10 years. After that, we still keep the data related to your license in order to identify you and provide activation codes. You can request to be removed from our records, losing the technical possibility to activate the program as a result.

Sharing your information

We do not sell, rent, trade, or otherwise share any personal data with third parties. Your data is only shared with our trusted subcontractors (like Paddle, Mixpanel, and ActiveCampaign) who apply strict security policies.

Accessing your information (GDPR)

You have a right to request a copy, rectification, or erasure of the information that we hold about you. If you have any questions or requests, please email us at hello@copytrans.studio.

Marketing & Analytics

We occasionally send promotional emails through ActiveCampaign. You may unsubscribe at any time. We also use Mixpanel to anonymously track behavior on our website and applications.

Place of Jurisdiction

This agreement is governed by French law. Any dispute relating to the execution of this agreement shall fall under the exclusive jurisdiction of the courts of Paris, France.
